This webinar will focus on clarifying the recent independent contractor ruling that was finalized on January 10th by the Department of Labor. This rule rolls back a Trump-era rule offering guidance on determining employee or independent contractor classification under the Fair Labor Standards Act. This rules volatility is causing some anxiety in the industry. Department of Labor (DOL) rules governing the classification of independent contractors will revert to the pre-2021 changes March 11 – rule changes that impact contractors in all careers but have vast implications for owner-operator truck drivers and fleets that use them.

Tom joined J.J. Keller & Associates, Inc. in 2005 as an editor in the Transportation Publishing Department, Editorial Resource Area. Tom specializes in motor carrier safety and operations management. He serves as editor of the monthly Transportation Safety Managment Today newsletter for both print and online publication. Tom also contributes to the development of forms, training programs and kits, software, and online services.
Before joining J.J. Keller & Associates, Tom had 23 years of industry experience. While employed in the industry, Tom held various safety-related positions, including driver, driver trainer, claims manager, safety supervisor, lead instructor, and Safety Director. As Safety Director, he was responsible for DOT compliance, policy development, driver human resources, driver training, CDL testing, and accident prevention for a fleet of 350 trucks and drivers.
Tom is involved in the National Private Truck Council, Wisconsin Motor Carriers Association, and Wisconsin Safety Management Council. He has completed all of the roadside inspector training courses offered by the Commercial Vehicle Safety Alliance (CVSA) and has been a voting committee member and program secretary for CVSA. He is also an instructor at MidState Technical College, a chief officer and advanced emergency medical technician for the Amherst, WI fire department, and previously served as a fire investigator on the Portage County Fire Investigation Task Force.

Darlene (Dolly) is an Editor- HR, writing about employment laws such as the federal Family Medical Leave Act, the federal Americans with Disabilities act, state leave provisions, and the federal Fair Labor Standards Act, as well as applicable regulations, guidance, and court cases.
Dolly also provides input and support for the FMLA Manager. Through these products and services, Dolly fields many customers’ HR-related questions and helps customers understand their requirements by helping translate governmental verbiage into a more understandable language.
Dolly has had articles published in a variety of trade publications and newspapers, and was a contributing writer for the book Gender, Race & Ethnicity in Today’s Workforce: Emerging Issues and Enduring Challenges; Karsten, Margaret F. ed. She has also presented at various HR conferences and is a member of the national and local SHRM.
